Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and WiselyRise Solutions ("WiselyRise", "we", "us", or "our") governing your download, access, and use of the DateWise mobile application ("DateWise", "the app") and related services.

By downloading, installing, accessing, or using DateWise, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the app.

1. Eligibility & Acceptance

You must be at least 13 years old (or the age of majority in your jurisdiction) to use DateWise. By using DateWise, you represent and warrant that you have the legal capacity to enter into these Terms.

2. Description of Service

DateWise is a privacy-first personal reminder, milestone tracking, and relationship organization mobile application designed for Android devices. The app offers two service tiers:

• Free Tier: Includes unlimited personal reminders, smart timeline grouping (Today, Tomorrow, This Week, This Month, Later), interactive calendar view, smart notifications with customizable advance alerts, on-device voice announcements (Text-to-Speech), resizable home screen widgets, Inbox capture, in-app Recycle Bin, biometric app lock, local backup and JSON export, contact birthday import, and People Hub access for up to 5 people profiles, plus 3 free Smart Add trials.
• Pro Tier (One-Time In-App Purchase): Unlocks unlimited people profiles in People Hub, unlimited Smart Add sessions, Google Drive Cloud Backup and multi-device sync (with optional avatar photo sync), custom reminder types with over 120 custom emojis, custom reminder intervals, custom relationship tags, and Pro statistics dashboard. Additional Pro features may be added over time at no extra charge to existing Pro users.

3. Offline Architecture & User Accounts

• DateWise does not require user registration, username creation, or cloud sign-in for any core offline functionality.
• All core data is stored exclusively in a sandboxed SQLite database on your device.
• Google Sign-In is required solely if you choose to activate the optional Google Drive Cloud Backup feature (Pro). You are solely responsible for maintaining the security and confidentiality of your Google account credentials.

4. Smart Add & Voice Input Terms

• Assistive Tool Only: Smart Add is an on-device rule-based parsing and speech recognition aid designed for user convenience. DateWise does not use artificial intelligence (AI) or machine learning models. Because natural language parsing relies on heuristic keyword and date-pattern rules, it may not interpret every phrasing correctly.
• Mandatory User Verification: You are solely responsible for reviewing and verifying all pre-filled reminder details (including the scheduled date, time, category, and recurrence rule) before tapping "Save Reminder". WiselyRise disclaims any liability for missed reminders, mistaken dates, or scheduling errors resulting from speech recognition transcription mistakes or parsing ambiguities.
• Free Trials: Free users receive 3 free Smart Add trial uses. Once these 3 trials are consumed, Smart Add requires DateWise Pro. Manual reminder creation remains 100% free and unlimited at all times.

5. People Hub & Contact Import

• Free Tier Capacity: Free users may create up to 5 contact profiles in the People Hub. Upgrading to DateWise Pro removes this cap. Existing contact data will never be deleted if you reach the free limit; purchasing Pro simply unlocks the ability to add additional profiles.
• Lawful Contact Import: When using the "Import from Contacts" feature, you represent that you have the lawful right to import your device contacts' names and birth/anniversary dates for your own personal, non-commercial use.
• External Communication Shortcuts: DateWise provides one-tap shortcut buttons to launch your device's native phone dialer or third-party messaging apps (such as WhatsApp) to send wishes. DateWise does not operate these third-party services and bears no responsibility for message transmission, third-party carrier fees, or messaging platform availability.

6. Pro In-App Purchase & Billing

6.1 One-Time Lifetime License

DateWise Pro is offered as a one-time, non-consumable in-app purchase (₹49 in India; regional pricing set by Google Play). DateWise Pro is NOT a subscription. There are no recurring fees, no automatic renewal charges, and no hidden monthly or annual costs.

6.2 Billing & Payment Processing

All in-app purchases are processed securely by Google LLC through Google Play In-App Billing. WiselyRise does not collect, receive, or store your payment card or banking information. Your purchase is subject to the Google Play Terms of Service.

6.3 Refunds

Refunds are administered directly by Google Play in accordance with Google Play's Refund Policies. If you encounter any technical issues or need assistance with your purchase, please contact our support team at contact@wiselyrise.in.

6.4 License Restoration

Your Pro license is tied to your Google Play account. You can restore your purchase on any compatible Android device logged into the same Google account by tapping "Restore Purchase" in DateWise Settings.

7. Cloud Backup, Multi-Device Sync & Conflict Resolution

• Google Drive AppData Storage: Cloud backup stores your data in your personal Google Drive account's sandboxed Application Data folder. WiselyRise does not own, manage, or host this storage infrastructure.
• Conflict Resolution (Merge vs. Overwrite): When synchronizing across multiple devices with conflicting data, DateWise prompts you to select either Merge (combining data) or Overwrite (replacing data). You are solely responsible for your choice of conflict resolution. WiselyRise is not liable for data overwrites, accidental deletions, duplicate records, or data inconsistencies resulting from user-selected conflict actions.
• Service Interruptions: WiselyRise is not responsible for cloud backup failures, sync delays, or data loss caused by Google Drive outages, network disconnections, Google account suspensions, or device storage quotas.
• Local Backup Recommendation: We strongly urge users to periodically create an offline JSON backup via Settings → Local Backup.

8. Critical Disclaimers: Medical, Financial, Legal & Time-Sensitive Reliance

You assume full responsibility for maintaining independent calendars, primary alarm systems, and professional safeguards for all critical health, financial, and legal commitments. WiselyRise expressly disclaims any liability for bodily injury, health complications, financial penalties, late fees, interest charges, legal damages, or missed opportunities arising from your reliance on DateWise.

9. Notification Delivery & Operating System Limitations

DateWise utilizes Android exact alarms to schedule notifications. However, timely notification delivery is subject to factors outside WiselyRise's control, including:

• Operating system battery optimization algorithms (Android Doze mode).
• Aggressive manufacturer-specific background task killers (such as those on Xiaomi MIUI/HyperOS, Samsung One UI, Oppo/Vivo ColorOS, and OnePlus OxygenOS).
• Operating system notification permission states (POST_NOTIFICATIONS).
• Device sound modes (Silent, Vibrate, Do Not Disturb / Priority Only).
• User-configured mute scopes (muting specific cards, tones, or voice alerts within DateWise).
• Device hardware reboots where the device has not been unlocked following boot.

WiselyRise does not warrant that notifications or voice announcements will always be delivered on time, audibly, or without delay.

10. Recycle Bin & Data Deletion

Deleted reminders are moved to the in-app Recycle Bin and retained locally on your device until you choose to restore them or permanently delete / empty the bin. If you have enabled "Auto-Move to Recycle Bin", expired one-time reminders will also move there. WiselyRise bears no liability for data permanently deleted from the Recycle Bin or following manual emptying of the bin.

11. User Content & Intellectual Property

• Your Content: You retain complete ownership of all reminders, notes, contact entries, and text you input into DateWise ("User Content"). We do not inspect, monitor, or claim ownership of your User Content.
• WiselyRise Intellectual Property: The DateWise application, software code, graphic designs, logos, custom reminder icons, user interface, and branding are the exclusive intellectual property of WiselyRise Solutions and are protected by applicable copyright, trademark, and intellectual property laws.
• Limited License: WiselyRise grants you a personal, non-exclusive, non-transferable, revocable license to use DateWise on your personal Android device in accordance with these Terms.

12. Acceptable Use Restrictions

You agree not to:

• Decompile, reverse-engineer, disassemble, or attempt to derive the source code of DateWise.
• Modify, adapt, translate, or create derivative works based on the app.
• Circumvent or bypass licensing mechanisms, feature locks, or trial counters.
• Rent, lease, sublicense, resell, or distribute DateWise to any third party.
• Use DateWise for any unlawful, harassing, defamatory, or fraudulent purpose.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATEWISE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WISELYRISE EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DATEWISE WILL BE UNINTERRUPTED, SECURE, ACCURATE, ERROR-FREE, OR COMPATIBLE WITH EVERY HARDWARE MODEL OR OS VERSION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WISELYRISE SOLUTIONS, ITS FOUNDERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, MISSED APPOINTMENTS, MISSED MEDICATIONS, FINANCIAL LATE FEES, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DEVICE MALFUNCTION), ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE DATEWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, WISELYRISE'S TOTAL AGGREGATE LIABILITY ARISING UNDER OR RELATED TO THESE TERMS OR YOUR USE OF DATEWISE SHALL NOT EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DATEWISE PRO LICENSE (OR ₹49 INR, WHICHEVER IS GREATER).

15. Indemnification

You agree to defend, indemnify, and hold harmless WiselyRise Solutions and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms, your misuse of the app, or your violation of any third-party rights (including privacy rights of imported contacts).

16. Termination

These Terms remain in effect until terminated. You may terminate these Terms at any time by uninstalling and ceasing all use of DateWise. Because DateWise is a 100% offline, locally-installed application with no user accounts, WiselyRise has no technical means to remotely suspend or revoke access. However, if you materially breach these Terms, your licence to use DateWise terminates automatically. Upon such termination, you must cease all use of the app and delete it from your device.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of DateWise shall be subject to the exclusive jurisdiction of the competent courts located in Tamil Nadu, India.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be severed from these Terms. The validity and enforceability of all remaining provisions shall not be affected in any way.
